New Jersey Appellate Attorney — When the Trial Court Got It Wrong
An adverse trial court decision is not the end of the road. The New Jersey Appellate Division, the New Jersey Supreme Court, and the federal appellate courts provide pathways to correct legal errors — and Sean Branigan has the experience and the preparation to pursue them.
Appellate practice is a specialized discipline. It requires a different set of skills than trial practice — the ability to identify the strongest legal arguments, to write with precision and persuasion, and to present complex legal issues to appellate judges who are looking for reasons to affirm, not reverse. Sean brings all of these skills to every appeal.
He also handles appeals as a fresh set of eyes — reviewing trial court records for errors that trial counsel may have missed, identifying the strongest grounds for reversal, and building the most compelling appellate record possible. His trial lawyer background gives him a unique perspective on appellate practice — he understands what happened at trial and why it matters on appeal.
Whether you lost at trial and need to appeal, or you won at trial and need to defend the judgment — Sean is the appellate attorney who prepares thoroughly and argues persuasively.

Common Questions
In civil cases, a notice of appeal must be filed within 45 days of the entry of judgment. In criminal cases, the deadline is 45 days from the date of sentencing. These deadlines are strictly enforced — missing the deadline can forfeit the right to appeal. Call Sean immediately if you are considering an appeal.
The standard of review determines how much deference the appellate court gives to the trial court's decision. Legal conclusions are reviewed de novo (without deference). Factual findings are reviewed for clear error. Discretionary decisions are reviewed for abuse of discretion. Sean identifies the most favorable standard of review for each issue on appeal.
A direct appeal challenges the trial court's legal rulings and is filed shortly after judgment. Post-conviction relief (PCR) is a separate proceeding that challenges the conviction based on grounds that could not have been raised on direct appeal — including ineffective assistance of counsel and newly discovered evidence. Sean handles both.
A typical civil appeal in the New Jersey Appellate Division takes 12-18 months from filing to decision. Criminal appeals may take longer. Emergency applications can be decided in days. Sean advises clients on realistic timelines and manages the appellate process efficiently.
A strong appellate case has a clear legal error that affected the outcome, a well-preserved record, and a compelling legal argument for reversal. Sean assesses every potential appeal honestly — identifying the strongest grounds and advising clients on the realistic prospects for success.
